Prin Hotărârea Plenului Consiliului Superior al Magistraturii nr. 115 din 12 august 2022 au fost avizate favorabil proiectul de Lege privind statutul judecătorilor şi procurorilor, proiectul de Lege privind organizarea judiciară şi proiectul de Lege privind Consiliul Superior al Magistraturii, cu observațiile prezentate în anexa care face parte integrantă din respectiva hotărâre.
Hotărârea a fost adoptată de Plen cu o majoritate de peste 2/3 din voturile membrilor Consiliului, observațiile formulate în aviz având un caracter preponderent tehnic - link: http://old.csm1909.ro/csm/linkuri/22_08_2022__107328_ro.pdf.
Așa cum s-a arătat și în cuprinsul avizului, principalele aspecte propuse prin proiecte cu privire la statutul judecătorilor și procurorilor și sistemul judiciar, în ansamblul său, corespund, în esență, viziunii Consiliului Superior al Magistraturii, răspunzând atât nevoii de a menține acele soluții legislative care și-au dovedit eficiența, cât și celei de a implementa soluții diferite de cele consacrate, dacă acestea din urmă nu mai corespund realităților din sistem.
De altfel, în procedura de avizare, Consiliul Superior al Magistraturii a solicitat punctele de vedere ale instanțelor și parchetelor cu privire la propunerile formulate, proiectele de lege transmise spre avizare fiind apreciate de majoritatea acestora, observațiile înaintate având în general un caracter tehnic.
În concluzie, atât Consiliul Superior al Magistraturii, în largă majoritate, cât și cele mai multe instanțe și parchete, susțin caracterul preponderent pozitiv al celor trei proiecte de lege.
În același timp, Consiliul se va implica în continuare în procesul legislativ în conformitate cu principiul cooperării loiale, observațiile reținute în hotărârea de avizare urmând a fi susținute și în cadrul procedurii parlamentare, în scopul asigurării tuturor garanțiilor pentru consolidarea independenței sistemului judiciar și realizarea unui act de justiție la standarde înalte, contribuind astfel la creșterea încrederii întregii societăți în justiție.

By the Decision no. 115 of 12 August 2022 of the Plenum of the Superior Council of Magistracy, the draft Law on the Status of Judges and Prosecutors, the draft Law on Judicial Organisation and the draft Law on the Superior Council of Magistracy were positively endorsed, with the observations set out in the annex that forms an integral part of this decision.
The decision was adopted by the Plenum by a majority of more than 2/3 of the votes of the members of the Council, the observations made in the opinion being of a predominantly technical nature — link:

As stated in the opinion, the main issues proposed by these drafts laws on the status of judges and prosecutors and the judicial system as a whole correspond, in essence, to the vision of the Superior Council of Magistracy, responding both to the need to maintain those legislative solutions that have proven their effectiveness and to implement solutions different from those enshrined, if the latter no longer correspond to the realities of the system.
Moreover, in the endorsement procedure, the Superior Council of Magistracy requested the points of view of the courts and of the prosecutor’s offices on the proposals made, the draft laws submitted for approval being upheld by the majority of them, the observations submitted being generally of a technical nature.
In conclusion, both the Superior Council of Magistracy, in a large majority, as well as most courts and prosecutor’s offices, support the predominantly positive character of the three draft laws.
At the same time, the Council will continue to engage in the legislative process in accordance with the principle of loyal cooperation, with the observations retained in the endorsement decision to be supported also in the parliamentary procedure, with the aim of ensuring all guarantees to strengthen the independence of the judiciary and to achieve of a high-standard act of justice, thus contributing to increasing the confidence of the whole society in the justice system.
